How does settlement affect the Klamath Project on ESA issues? Settlement provides a budget and support from the US Fish & Wildlife Service and the National Marine Fisheries Service to develop a regulatory assurances program that would protect the Project from “takings” litigation. This program cannot be 100% assured to be effective, but the actions of the Project to reduce its use of water in certain years, to support dam removal, and to support funding for voluntary habitat restoration are recognized in the settlement agreement as major reasons to protect the Project with regulatory assurances programs.
